Welcome to hwthinking.in. hwthinking.in is the personal mentoring and educational platform of Palash Khandale, operated in association with Tranquil Light Foundation, a Section 8 not-for-profit company incorporated under the Companies Act, 2013 ("TLF"). By accessing the Website or booking any service offered through it, you agree to be bound by these Terms and Conditions.

1. Nature of Services

1.1

hwthinking.in offers online, virtual services only, including: 1:1 career mentoring sessions, technical guidance sessions, mock interviews, multi-session training and bootcamp packages, and webinars, workshops, and similar educational content.

1.2

All sessions are conducted online via Google Meet, Zoom, or another mutually agreed video-conferencing tool. No physical goods are sold, shipped, or delivered through this Website.

1.3

Sessions are scheduled and delivered in Indian Standard Time (IST) unless otherwise agreed in writing.

2. Eligibility

2.1

The Website and its services are intended for users 18 years of age or older. If you are below 18, you may use the services only under the supervision of a parent or legal guardian who accepts these terms on your behalf.

2.2

By booking a session, you represent that the information you provide during booking is true, accurate, and complete.

3. Bookings and Payments

3.1

Bookings are confirmed only after successful payment via Razorpay and receipt of a confirmation email from us.

3.2

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

3.3

Payments are collected by Tranquil Light Foundation and are treated as donations to the Foundation. Where eligible, donation receipts will be issued under Section 80G of the Income Tax Act, 1961 subject to and within the validity of TLF's provisional approval.

3.4

We reserve the right to revise pricing, session content, duration, and availability at any time without prior notice. Pricing in effect at the time of your booking will apply to that booking.

4. Cancellations, Refunds, Rescheduling

4.1

Cancellation, refund, rescheduling, and no-show policies are set out in the Cancellation and Refund Policy available on this Website, which forms an integral part of these Terms.

5. User Conduct

5.1

During any session, you agree to behave respectfully and professionally, not record or transcribe any part of the session without prior written consent, not share session access links or materials with any third party, and not use the session to solicit, recruit, or market to the mentor or other participants.

5.2

We reserve the right to terminate any session, without refund, if the User engages in abusive, harassing, threatening, or otherwise inappropriate conduct.

6. Confidentiality and Professional Boundaries

6.1

The mentor will not disclose any information that is proprietary or confidential to the mentor's current or past employer(s). Guidance is provided based on general industry experience only.

6.2

You agree not to ask the mentor for confidential information belonging to any company, including internal interview questions, proprietary designs, trade secrets, or non-public business information.

6.3

You agree to keep confidential any non-public information that the mentor may share with you during a session.

7. Intellectual Property

7.1

All content on this Website, including text, graphics, logos, course materials, slides, recordings, blog posts, and code samples, is the property of Palash Khandale and/or TLF, or is used with permission, and is protected by applicable intellectual property laws.

7.2

You may not reproduce, distribute, publicly display, modify, or create derivative works of any content from this Website without our prior written permission.

7.3

Materials shared with you during a session are for your personal, non-commercial use only.

8. Disclaimers

8.1

The information, mentorship, and guidance offered through this Website is for educational and informational purposes only.

8.2

We do not guarantee any specific career outcome, job offer, interview result, salary outcome, promotion, admission, or other result from any session or package.

8.3

The Website and its services are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied.

9. Limitation of Liability

9.1

To the maximum extent permitted by law, in no event shall Palash Khandale, TLF, their directors, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website or its services.

9.2

Our total cumulative liability for any claim arising out of or relating to a booking shall not exceed the amount actually paid by you for the specific session or package giving rise to the claim.

10. Indemnity

10.1

You agree to indemnify and hold harmless Palash Khandale, TLF, and their respective directors, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your violation of any rights of any third party.

11. Privacy

11.1

Your use of the Website is also governed by our Privacy Policy, which forms an integral part of these Terms.

12. Third-Party Services

12.1

The Website integrates with third-party services including Razorpay (payments), Google Meet / Zoom (video conferencing), and email delivery providers. Your use of those services is subject to their respective terms and privacy policies, and we are not responsible for their acts or omissions.

13. Changes to These Terms

13.1

TLF and hwthinking.in reserve the right to modify, update, or replace these Terms and Conditions at any time, at our sole discretion, without prior notice.

13.2

The revised Terms will be posted on this page with an updated effective date. Your continued use of the Website after such changes constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

14.1

These Terms shall be governed by and construed in accordance with the laws of India.

14.2

Subject to clause 14.3, the courts at Nagpur, Maharashtra, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the use of the Website.

14.3

Either party may, at its option, refer any dispute to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Nagpur, and the language shall be English.
